Terms of service

These terms govern every Palm & Pumpkin reservation. They're written to be clear and fair — so you know exactly what we deliver, and we both know where our responsibilities begin and end. By reserving a display, you agree to them.

1. What we do

Palm & Pumpkin is a concierge seasonal styling service. We hand-source pumpkins, gourds, hay, and autumn botanicals and design and install them at the entry, porch, or exterior of your home according to the package you reserve. We are a decorative styling service — not a landscaping, construction, or general contracting service.

2. Booking, payment, and cancellations

Reservations are confirmed when payment is received in full. Prices, package contents, and any add-ons are as shown at the time you reserve. Changes, cancellations, and refunds are governed by our separate Cancellation & Refund Policy, which is incorporated into these terms by reference. Please read it — it explains our reservation cutoff and the restocking fee that applies to late cancellations.

3. What our designers will — and won't — do

Our designers will: style the entry, porch, steps, and immediate exterior area covered by your package; select and arrange materials using their professional design judgment; work within the footprint and scope of the package you purchased; and make reasonable efforts to reflect any color or style preference you share in advance.

Our designers will not: guarantee an exact match to a reference photo, inspiration image, or another home's display — every install is an original arrangement made from that day's available natural materials; perform any structural, rooftop, height, ladder, or electrical work; drill, nail, adhere to, or otherwise alter or attach anything to your home's surfaces or structure without your explicit prior permission; move, relocate, or work around vehicles, furniture, or heavy objects; decorate interiors; or continue work in conditions our crew judges unsafe.

Final aesthetic decisions — placement, proportion, color balance, and composition — rest with the designer's professional discretion within the scope of your package. Requests beyond your package's scope may be accommodated as a paid upgrade, subject to availability.

4. Delivery and installation timing

At booking we'll agree on an installation date or target window. Specific arrival times are estimates, not guarantees. Installation timing can be affected by weather, supply availability, traffic, property access, and other factors, some outside our control. A delay does not constitute a breach of these terms; if we're delayed, we'll communicate promptly and reschedule at the earliest workable time. We are not responsible for consequential losses tied to timing (for example, an event the display wasn't installed in time for), though we will always make reasonable efforts to meet your date.

5. Natural materials and freshness

Pumpkins, gourds, hay, cornstalks, and botanicals are natural, perishable agricultural products. Their size, shape, color, texture, and finish vary naturally, and that variation is part of the look — it is not a defect.

We do not warrant or guarantee that any material will remain fresh, firm, unblemished, or intact for any particular length of time. Once a display is installed, its lifespan depends on conditions entirely outside our control, including heat and direct sun, humidity, irrigation and sprinkler overspray, insects and wildlife (squirrels, rodents, birds, and others are fond of pumpkins), and handling by your household, guests, pets, or service providers.

Because seasonal decline is normal and expected, it is not treated as damage or a defect. If your display naturally fades before season's end, our Mid-Season Refresh (available as a paid add-on) is the intended and exclusive remedy — we'll return and replace declined materials to restore the look. This is separate from the damage- or error-on-arrival protection described in our Cancellation & Refund Policy, which covers a display that arrives materially wrong or damaged (reported within 48 hours of install).

Placement. For both safety and longevity, we place displays on dry, firm, well-drained surfaces — porches, steps, stone, tile, brick, or pavers — and keep walkways and entries clear so paths stay safe to use. Grass, soil, mulch, planting beds, and other landscaped or irrigated areas hold moisture and significantly accelerate the breakdown of natural materials. If you request or direct placement in grass, landscape, or moisture-prone areas, or if you move materials into such areas after installation, the resulting accelerated decay is at your own risk: we will not replace the materials or be liable for their condition, and the Mid-Season Refresh (available as a paid add-on) is the only avenue for restoring the display. Where a property offers no suitable hard surface, we'll advise you of the trade-off and proceed only with your acknowledgment.

6. Removal and teardown

Removal is included only if you purchase it as an add-on. If you do not, the display and all its materials become yours to keep, maintain, and dispose of at the end of the season.

Where removal is purchased, we'll remove the materials we installed by the agreed end-of-season removal window. Removal requires the same property access as installation (see Section 7). If we cannot access the property at the scheduled removal — a locked gate, no entry code, an unsecured pet, or similar — we'll make one reasonable attempt to reschedule; if access continues to be unavailable, our removal obligation is considered met and no refund is due for the removal service. We are not responsible for removing, or for the condition of, any materials you or others added, moved, or rearranged after our installation. Materials left in place past the removal window may be treated as abandoned and disposed of at our discretion.

7. Property access, authorization, and your responsibilities

By reserving, you represent and warrant that you own the property or are authorized to commission decorative work on it and to grant us access, and that you are responsible for compliance with any homeowners' association, building, permit, or community rules — including any fines or actions arising from the display. If HOA or association approval is required, obtaining it is your responsibility.

You agree to provide safe, timely access for installation and removal (including gate codes or entry arrangements), to secure pets during our visits, to disclose known site hazards in advance, and to keep children and guests clear of materials and tools during our work.

Waiting time and failed access. When our crew arrives within the agreed date or time window, we allow a 15-minute grace period for you or your representative to provide access. If entry is delayed beyond that grace period — because security, a representative, household staff, or a locked or coded entry prevents access through no fault of ours — standby time is billed at $75 per hour (charged in 15-minute increments) while our crew waits. If access cannot be provided during the agreed window and our crew has to leave and return another day, a flat $150 re-trip fee applies to cover the wasted visit and any re-sourcing of perishable materials, and your installation or removal is rescheduled subject to availability. These charges apply only when our crew has arrived within the agreed window; they never apply to a delay caused by us.

After installation, the display is part of your premises. You are responsible for keeping the surrounding area reasonably safe for your household, guests, and visitors — for example, ensuring pathways stay clear and materials aren't repositioned into a trip hazard. We do not supply, install, or endorse open-flame elements; if you add candles, lighting, electrical, or other elements to the display, you do so at your own risk.

8. Insurance and limitation of liability

Palm & Pumpkin carries general liability insurance covering our installation work. Nothing in these terms limits any liability that cannot lawfully be limited.

Subject to that, our total aggregate liability for any claim arising out of a reservation is limited to the amount you paid for that order. We are not liable for indirect, incidental, special, or consequential damages, or for damage to property or persons resulting from conditions outside our reasonable control, from your breach of these terms, or from acts of third parties, wildlife, weather, or your household after our work is complete.

To the extent permitted by law, you agree to indemnify and hold Palm & Pumpkin harmless from third-party claims arising out of your breach of these terms — including claims arising from work commissioned without proper authorization, from HOA or community violations, or from a failure to keep the display area safe after installation.

9. Substitutions

Natural inventory varies day to day. If a specific pumpkin variety, gourd, color, or botanical shown or discussed isn't available at sourcing, we'll substitute a comparable material of equal or greater value in keeping with the design. Substitution is not grounds for a refund.

10. Photography and marketing

We may photograph or film completed installations and use those images to promote Palm & Pumpkin across our website, social media, advertising, and marketing materials. We will not publish your name, street address, or identifying details of your property without your consent. If you'd prefer we not photograph or feature your home, simply tell us in writing before or within 7 days of your installation and we'll honor it.

11. Force majeure

We are not liable for failure or delay in performance caused by events beyond our reasonable control, including weather, fire, crop failure or supply shortage, labor disruption, illness, government action, or acts of God. Where such an event prevents delivery, our Cancellation & Refund Policy governs your remedy.

12. Right to decline or discontinue service

We may decline or discontinue service — including leaving a site — where conditions are unsafe, where access or authorization cannot be verified, or where a client's conduct toward our crew is abusive or threatening. Where we discontinue for safety or access reasons through no fault of our own, fees for work already performed or materials already sourced are non-refundable.

13. Governing law and disputes

These terms are governed by the laws of the State of California, and any dispute will be handled in the state or federal courts located in Los Angeles County. Before filing any claim, both sides agree to first attempt to resolve the matter informally by contacting the other in writing and allowing 30 days to reach a resolution.

14. General

If any provision of these terms is found unenforceable, the rest remain in effect. These terms, together with the Cancellation & Refund Policy and your reservation details, are the entire agreement between us. We may update these terms from time to time; the version in effect on your reservation date governs your order.
